Terms of Service

1. Acceptance of Terms

By accessing or using GenderJourney.xyz ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Service Description

GenderJourney.xyz is a web application designed to help individuals manage their gender journey, including:

  1. Health Tracking: Blood tests, hormone medications, blood pressure, weight, surgeries
  2. Personal Journey: Diary entries, voice recordings, progress photos
  3. Social Features: Optional "My Connect" community (can be enabled/disabled anytime)
  4. UK GRC Application Support: Document management and application tracking
  5. Health Indicators: Optional calculated scores based on your health data (for informational purposes only)


3. Eligibility and Account Registration


3.1 Age Requirement

You must be at least 16 years old to create an account. By registering, you confirm that you meet this age requirement.


3.2 Geographic Restrictions

The Service is not available to residents of the United States due to political considerations. The Service is available in the UK, EU, Canada, and other jurisdictions where permitted by law.


3.3 Account Information

To create an account, you must provide:

  1. Valid email address (used as username)
  2. Secure password (minimum 8 characters with mixed case, numbers, and symbols)
  3. Preferred first and last name
  4. Legal first and last name (optional, defaults to preferred name)
  5. Date of birth (for age verification)
  6. Gender identity
  7. Subscription plan selection (Free, Egg Cracking £1/month, or Hatched £3/month)


3.4 Account Security

You are responsible for:

  1. Maintaining the confidentiality of your password
  2. All activities that occur under your account
  3. Notifying us immediately of any unauthorized access
  4. Enabling Two-Factor Authentication (2FA) for enhanced security (optional but recommended)


4. User Responsibilities and Prohibited Conduct


4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  1. Share false, misleading, or fraudulent medical data
  2. Violate any applicable laws, regulations, or third-party rights
  3. Attempt to gain unauthorized access to other users' accounts or data
  4. Use the Service to harass, abuse, threaten, or intimidate others
  5. Post hate speech, discrimination, or offensive content
  6. Distribute malware, viruses, or harmful code
  7. Scrape, crawl, or use automated tools to access the Service
  8. Reverse engineer, decompile, or attempt to extract source code
  9. Abuse the free-tier service or violate Fair Use Policy
  10. Impersonate another person or entity


4.2 Content Moderation

If you enable "My Connect" social features, your posts, comments, and shared content are subject to moderation:

  1. AI-Assisted Moderation: Content is automatically scanned for policy violations
  2. Human Review: AI-flagged content is reviewed by human moderators
  3. Suspension: Violating content is suspended pending review
  4. User Reports: Reported content is suspended until reviewed by AI and human moderators


4.3 Intellectual Property

You retain ownership of content you create (posts, photos, voice recordings, diary entries). By sharing content via My Connect, you grant us a non-exclusive, worldwide license to display, distribute, and moderate that content within the Service.


5. Health Data and Medical Disclaimers


5.1 Not Medical Advice

IMPORTANT: GenderJourney.xyz is a health tracking tool, not a medical service. The Service does NOT provide medical advice, diagnosis, or treatment.


5.2 Health Indicators Disclaimer

Health scores and indicators are for informational and entertainment purposes only. They are NOT clinically validated and should NOT be used for medical decision-making. Always consult a qualified healthcare provider for medical advice.

5.3 Voice Pitch Disclaimer

Voice pitch frequency tracking is opt-in and for informational purposes only. Pitch data is NOT medically accurate and should NOT be used for clinical assessment. The feature includes trigger warnings and can be disabled at any time.


5.4 Third-Party Health Data

If you import blood test results from Medichecks or other third-party services, you are responsible for the accuracy of that data. We are not liable for errors in third-party data.


5.5 Emergency Situations

The Service is NOT for emergencies. If you are experiencing a medical emergency, call emergency services immediately (999 in the UK, 112 in the EU).


6. Privacy and Data Protection

Your privacy is critically important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.


Key Points:

  1. All health data is encrypted at rest using AES-256-CBC encryption
  2. Your data is accessible only by you (no staff access to encrypted PHI)
  3. We comply with UK GDPR, Data Protection Act 2018, and PECR
  4. Health data is processed under explicit consent (UK GDPR Article 9(2)(a))
  5. You can delete your account and all data at any time
  6. Data is NOT sold, rented, or used for marketing


7. Subscription Plans and Payments


7.1 Free Plan

The core Service is free for life and includes:

  1. Health tracking (blood tests, hormones, blood pressure, weight, surgeries)
  2. Diary entries
  3. My Connect social features (optional)
  4. 7-day premium trial for new users


7.2 Paid Plans

  1. Egg Cracking Plan: £1/month - Includes My Photo Journey
  2. Hatched Plan: £3/month - Includes My Photo Journey + My Voice Journey


7.3 Payment Processing

Payments are processed securely by Stripe (PCI DSS Level 1 certified). We do NOT store your credit card numbers or CVV codes.


7.4 Billing and Renewals

  1. Subscriptions renew automatically each month
  2. You can cancel anytime via your account settings
  3. Cancellations take effect at the end of the current billing period
  4. No partial refunds for mid-month cancellations


7.5 Refund Policy

Refunds are provided ONLY in the following circumstances:

  1. Service Outage: If the Service is unavailable for more than 24 consecutive hours
  2. Billing Errors: If you were charged incorrectly
  3. Unauthorized Charges: If your account was compromised

7.6 Price Changes

We reserve the right to change subscription prices with 30 days' notice via email. Existing subscribers will be grandfathered at their current price for 6 months.


8. Limitation of Liability


8.1 Service "As Is"

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  1. Warranties of merchantability, fitness for a particular purpose, or non-infringement
  2. Warranties that the Service will be uninterrupted, error-free, or secure
  3. Warranties regarding the accuracy, reliability, or completeness of health data or insights


8.2 Limitation of Damages

To the maximum extent permitted by law, GenderJourney.xyz and its affiliates, officers, employees, and agents shall NOT be liable for:

  1. Any indirect, incidental, special, consequential, or punitive damages
  2. Loss of profits, revenue, data, or use
  3. Personal injury or property damage
  4. Damages arising from reliance on health insights, scores, or AI-generated content
  5. Service interruptions, malfunctions, or data loss beyond our reasonable control
  6. Third-party actions (e.g., Stripe, Mailjet, Medichecks, OpenAI)


Maximum Liability: Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.


8.3 Indemnification

You agree to indemnify, defend, and hold harmless GenderJourney.xyz from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  1. Your use of the Service
  2. Your violation of these Terms
  3. Your violation of any third-party rights
  4. Content you post or share via My Connect


9. Account Termination and Suspension


9.1 Termination by You

You may delete your account at any time via your profile settings. All data will be permanently deleted within 30 days.


9.2 Termination by Us

We reserve the right to suspend or terminate your account immediately if:

  1. You violate these Terms or our Acceptable Use Policy
  2. You engage in fraudulent, abusive, or illegal activity
  3. You fail to verify your identity after a security incident
  4. Your account is inactive for 3+ years (after email notification)
  5. We are required to do so by law or court order


9.3 Effect of Termination

Upon termination:

  1. Your access to the Service will be revoked immediately
  2. All data will be deleted within 30 days (except as required by law)
  3. Paid subscriptions will not be refunded (unless termination was our error)
  4. Sections 5, 8, 10, and 11 of these Terms survive termination


10. Governing Law and Dispute Resolution


10.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.


10.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.


10.3 Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting [email protected]. We will attempt to resolve disputes within 30 days.


11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  1. Email notification - 30 days before changes take effect
  2. In-app notification - Banner on your dashboard
  3. Updated "Last Updated" date - At the top of these Terms


Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.


12. Miscellaneous


12.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and GenderJourney.xyz.


12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.


12.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.


12.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.


12.5 Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
